Terms and Conditions Last Updated: 25/10/2025 Welcome to Finrush (referred to as “Company”, “We”, “Our”, or “Us”). By accessing or using our website https://finrush.in/ and subscribing to our services including WhatsApp API, WhatsApp Chat, Chatbot Replies/Bot Services, and Team Member/Agent Onboarding (collectively referred to as the “Services”), you (“User”, “Customer”, or “You”) agree to be bound by the Terms and Conditions outlined below. If you do not agree to these Terms, please refrain from using our Services. 1. Services Offered Finrush provides users with the following services through its platform: WhatsApp Business API integration WhatsApp Chat and messaging dashboard Chatbot / Automated reply system Team Members / Agents onboarding and management features Additional tools and communication enhancements for business users 2. Eligibility To use our Services, you confirm that: You are at least 18 years of age or a legally registered business entity. You have the authority to enter into agreements on behalf of your organization (if applicable). You agree to comply with all applicable laws, including Meta (WhatsApp) policies and Indian IT regulations. 3. Subscription Fees and Payment Terms The service fee is Rs. 599/- per month or Rs. 6,499/- per year (if paid in advance). Applicable GST and government taxes will be charged extra as per law. No markup fees are charged by Finrush on WhatsApp API usage. Per-message charges will be levied separately as per Meta (WhatsApp Business API) pricing policy, and shall be payable by the User. Payments once made are non-refundable, except as required by applicable laws or at the sole discretion of Finrush. Service will remain active only upon receipt of full payment. 4. User Responsibilities By using our Services, you agree: To provide accurate business and contact information during registration. To ensure your content and communication comply with WhatsApp Business Policy, Meta Commerce Policy, and applicable laws. Not to use the platform for spam, fraud, harassment, misleading advertising, unlawful activities, or sharing illegal content. To maintain the confidentiality of your login credentials and account activity. To obtain necessary approvals for customer communication and ensure compliance with data protection regulations. 5. WhatsApp API and Messaging Policy All messaging through our platform is subject to Meta/WhatsApp’s rules, templates, and pricing. Message delivery is dependent on WhatsApp servers and user consent. Finrush does not guarantee message delivery rates or response times. Any suspension by Meta due to non-compliance is the sole responsibility of the User. 6. Data Privacy & Confidentiality Finrush may collect necessary data such as business details, contact information, chats, and analytics only to deliver services. User data will not be sold or shared with third parties except for service providers such as Meta/WhatsApp or as required by law. Users must seek prior consent from their customers before sending messages or saving customer data. 7. Termination and Suspension Finrush reserves the right to suspend or terminate access to Services in case of: Non-payment of subscription or message charges Violation of these Terms or applicable laws Misuse of the WhatsApp platform or API services Legal or regulatory orders Upon termination, access to your account, chats, and services may be disabled. 8. Limitation of Liability Finrush is a facilitator of WhatsApp Business API solutions and does not own or control WhatsApp or Meta services. We are not liable for indirect, incidental, or consequential damages including loss of business, profits, or data. Service interruptions due to third-party platforms (Meta, hosting providers, internet downtime) are beyond our control. 9. Indemnity You agree to indemnify and hold Finrush, its directors, employees, and partners harmless from any claims, losses, penalties, or damages arising due to: Your misuse of the platform Violation of WhatsApp or Meta policies Any illegal or unauthorized communication sent from your account 10. Jurisdiction and Legal Disputes All disputes are subject to the exclusive jurisdiction of courts at Aligarh, Uttar Pradesh, India. This agreement shall be governed by the laws of India. 11. Modification of Terms Finrush reserves the right to change or update these Terms at any time without prior notice. Continued use of the Services after such modifications constitutes your acceptance of the revised Terms. 12.
